Terms of service of Experts by OStory Platform

Experts by OStory Platform, with its registered office in Kraków, Poland, address: Bociana 6B/46, e-mail: experts@ostoryplatform.com, is the owner and administrator of the platform available at [site address], hereinafter referred to as the Platform.

1. Definitions

1. Platform – an online service connecting Clients with Experts in social media and content creation.
2. Administrator – the owner of the Platform: Experts by OStory Platform.
3. User – any natural or legal person who created an account on the Platform.
4. Expert – a User offering services in social media and content creation.
5. Client – a User looking for Expert services.
6. Agreement – an agreement concluded between the Client and the Expert outside the Platform as a result of contact initiated through the Platform.
7. Terms – this document.

2. General provisions

1. The Terms define the rules for using the Platform, including registration, publishing profiles, communication and rating Experts.
2. Each User, by creating an account, accepts the Terms.
3. The Administrator may amend the Terms; Users will be informed of changes via e-mail or in-app notification.

3. Scope of Platform services

1. The Platform enables:
   • account registration and login,
   • creating an Expert profile with a service offer,
   • searching for Experts via the search engine (including using AI algorithms and embeddings),
   • sending and receiving messages,
   • adding reviews and ratings of Experts after cooperation ends,
   • receiving in-app notifications and system e-mails.
2. The Platform does not participate in service delivery and does not bear responsibility for their quality. Agreements between Clients and Experts are concluded outside the Platform.

4. Registration and account

1. Creating an account is voluntary and requires providing: e-mail address, first name, last name, role (Client/Expert).
2. The User is obliged to provide truthful data.
3. The account may be deleted:
   • at the User’s request,
   • in case of violation of the Terms,
   • in the event of actions violating the law.

5. Rules of use

1. It is prohibited to:
   • publish content that is unlawful, offensive or misleading,
   • spam, send unsolicited offers,
   • attempt to bypass the rating system or manipulate reviews.
2. The User undertakes to:
   • use the Platform according to its intended purpose,
   • keep login data confidential,
   • not share their account with third parties.

6. Reviews and ratings

1. Reviews can only be posted by Clients who actually worked with a given Expert.
2. Reviews must be truthful and may not violate personal rights.
3. The Administrator reserves the right to remove reviews in case of violations of law or principles of social coexistence.

7. Liability

1. The Administrator is not responsible for:
   • content published by Users,
   • quality of services provided by Experts,
   • any damages arising from agreements concluded between Clients and Experts.
2. For functionalities using artificial intelligence (AI), including expert search using embeddings, the Administrator:
   • does not guarantee 100% correctness of results, recommendations or their fit to the User’s needs,
   • is not responsible for decisions made based on AI-generated suggestions,
   • reserves that search results are supported by learning algorithms that may produce approximate or imprecise results.
3. The Administrator makes efforts to ensure the Platform operates continuously, however reserves the right to technical breaks.

8. Personal data

1. The personal data controller is Experts by OStory Platform.
2. Data are processed in accordance with the Privacy Policy available at /privacy.
3. The User has the right to access, correct and delete data and to file a complaint with the President of the Personal Data Protection Office.

9. Termination of the agreement and account deletion

1. The User may stop using the Platform at any time.
2. The Administrator may delete an account in case of violations of the Terms.

10. Final provisions

1. The Terms enter into force on the date of publication on the website.
2. Matters not regulated are governed by Polish law.
3. All disputes will be resolved by the court competent for the Administrator’s seat.
